These Terms of Service apply to all online courses, programs, memberships and digital products (Course or Courses) provided by Birdcage Group Pty Ltd, trading as Birdcage Angel Advisors (Company, we, us, our). By enrolling or accessing any Course, you (you, your, User) agree to be bound by these Terms. If you do not accept these Terms, you are not authorised to access or use the Course.
1. Introduction
Your enrolment in any Course constitutes your agreement to comply with these Terms. If you do not agree, you must not enrol or access the Course.
2. Intellectual Property Rights
All Course content, including videos, text, graphics, branding, frameworks, tools, templates, worksheets, software and all intellectual property, is owned by the Company or its licensors.
You are granted a limited, non-exclusive and non-transferable licence to access the Course for personal and non-commercial use only.
You must not reproduce, distribute, modify, share, sell, post, publish, sub-licence or create derivative works from any Course content without prior written consent from the Company. Any unauthorised use is a breach of these Terms and may result in termination of access without refund, and legal action where appropriate.
3. Disclaimer of Warranties
Courses are provided on an "as is" and "as available" basis. We make no guarantees regarding:
• outcomes or results
• accuracy or completeness of content
• uninterrupted access
• suitability of the Course for your specific circumstances
You acknowledge that you are responsible for your own implementation and outcomes.
To the extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for purpose. Nothing in these Terms excludes any rights you may have under Australian Consumer Law.
4. Limitation of Liability
To the fullest extent permitted by law, the Company is not liable for:
• indirect, incidental or consequential loss
• loss of profits, business, goodwill, data or reputation
• your reliance on Course content
• any unauthorised use or access to your account
Where liability cannot be excluded under Australian Consumer Law, it is limited to resupply of the Course or a refund at our discretion.
5. Use of Student Work and Testimonials
By participating in a Course, you grant the Company a perpetual, worldwide, royalty-free licence to use any submissions, feedback, testimonials, comments, messages, screenshots or materials you provide in relation to the Course. This includes use for marketing, training, case studies and promotional purposes.
You may withdraw consent for public testimonial use by contacting us at [email protected]. Withdrawal applies to future use only, not existing materials already published.
6. Money Back Guarantee
A forty-eight hour (48-hour) money back guarantee is offered only on your first-time initial purchase of a Course. The guarantee does not apply to:
• automatic renewals
• accidental renewals
• repeat enrolments
• returning customers
• upgrades or additional products
• subsequent purchases of any kind
Eligibility Requirements
To qualify for the guarantee, you must:
• not access or view any training module that contains downloadable resources
• not download, save, screenshot or otherwise capture any proprietary tools, templates, worksheets, PDFs, frameworks or files
• not access MaddyChat or any AI-based tools included in your Course
• submit your request in writing to [email protected] within forty-eight (48) hours of the initial purchase
You acknowledge that once you access a training module containing downloadable resources, we cannot verify whether you downloaded materials.
For this reason, accessing any such module voids the guarantee immediately.
Refund Process
If eligible, your refund will be processed and your access to the Course revoked immediately.
Guarantee Limitations
After the 48-hour period, or if you access any restricted materials or tools, all fees are final and non-refundable except as required by Australian Consumer Law. The guarantee cannot be used for subscription renewals, regardless of whether renewal reminders were received.
7. Refund Policy
Beyond the Money Back Guarantee, all sales are final. Refunds are not provided for change of mind, non-use, inability to attend, financial hardship or perceived lack of results.
We comply with Australian Consumer Law regarding faulty goods or services.
8. Payment Plans and Membership Billing
Full Library™ Yearly Membership
The Full Library™ is a subscription product that renews automatically every twelve (12) months unless cancelled prior to the renewal date.
We send renewal reminder emails in advance. To ensure you receive these reminders, you must add birdcagegroup.com to your email address book or safe senders list.
You acknowledge that:
• failure to receive renewal reminders due to email filtering, spam settings or user error does not constitute grounds for a refund
• the responsibility to cancel prior to renewal rests solely with you
If the renewal processes successfully, refunds are not provided except as required under Australian Consumer Law.
Payment Options
• Upfront: full payment for twelve months of access
• Monthly instalments: a minimum twelve-month financial commitment, paid monthly
By choosing monthly instalments, you agree to complete all twelve payments regardless of usage or circumstances.
Cancellations
You may request cancellation after the minimum term has ended. Email [email protected] before your next billing date to avoid renewal.
Payment Failures
If a payment attempt fails:
Your account will be marked Past Due.
We will attempt payment for up to three weeks.
If unsuccessful, your membership will be cancelled automatically.
You may manually re-run a failed payment via your Billing settings.
9. Chargebacks
Initiating a chargeback is a breach of these Terms. If you initiate a chargeback:
• your access will be revoked immediately
• you may be barred from future purchase
• we reserve the right to dispute the chargeback with evidence of your enrolment and agreement

10. Account Access and Security
Your account is for personal use only. You must not share your login credentials with any other person or entity.
We may monitor login activity. If we detect multiple users or unauthorised access, we may suspend or terminate your account without refund.
You are responsible for maintaining security of your own devices and passwords.
11. Behavioural Expectations
You agree not to engage in conduct that is abusive, defamatory, harmful, misleading or disruptive within any Course community, live call or platform.
We reserve the right to remove you from any Course or community if your conduct is inconsistent with these expectations, without refund.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be handled exclusively in Queensland courts.
15. Modifications to Terms
We may update these Terms at any time. Changes take effect immediately upon being posted on our website. Continued use of the Course indicates acceptance of updated Terms.
16. Entire Agreement
These Terms override any previous agreements, representations or discussions relating to the Courses.
